According to § 3 regulations of the Council of Ministers from May 28,1996 on preventive meals and drinks, the duty of ensuring preventive meals by the employer is regarding only these employees who are working below the ground and on the surface in particularly harmful conditions.
Therefore the management Board in January 2014 made a decision to cease giving the preventive meal to the surface and administration workers, who do not fulfill the requirements of the regulation. What's more, the ruling clearly specifies these employees who should have the energy expenditure compensated for, defining even kilocalories consumed during the work.
The Management Board claims that the right of all miners and Zakład Logistyki Materiałowej employees to have preventive meals are contrary to expectations of the ones, who have unquestionable right to it, because employees performing works associated with a physical effort are made equal with the ones who aren't meeting criteria of the regulation of the Council of Ministers.
Wanting to reach the common position in this matter, on April 22, 2014 the Management Board addressed the letter to trade union organizations concerning mutual cooperation on appointing the job positions giving rights to preventive meals. However the trade union side refused to collaborate.
Taking into consideration the economic situation of mining industry and anxiety of employees about places of employment, the management Board is appealing to the social side not to take activity aimed at provoking the strike.
Organising the strike in order to restore the preventive meal for the surface employees, administration and employees delegated to the trade union work which aren't working in particularly harmful conditions, will be an extreme irresponsibility towards employees in the face of the difficult situation of the mining industry, Jastrzębska Spółka Węglowa included.
