Workers put at risk

JSW Management Board declares that the procedure for redundancies in Budryk relates to local union leaders who organized illegal, underground strike on 14, 15 and 16 January 2015 during the strike in Kompania Węglowa.


The employer was obliged to respond when the organizers of the strike have exposed the people at risk by leading an illegal protest underground. We stress that the underground protest was led only and exclusively by Budryk trade unions, therefore the employer intends to take the appropriate measures against these organizations only. The remaining unions have conducted informational meetings and protests on the surface.

Nine organizers of the illegal protest below the ground in the Budryk mine are accused of breaking the provisions of the occupational health and safety and the regulations of solving collective disputes. The protest posed a threat to the health of its participants because employees remained  in places under ground, which was in contrast to the norms set by the managing director of the mine, beyond norms of working hours and triggered the chaos, especially in the issue of the place of staying and the migration of employees.

This is yet another case of illegal form of protest within the short time in the Budryk mine with exposing miners to danger by staying of employees below the ground beyond working hours limit, what is illegal. The previous action took place 3-4 of December 2014. At that time the employer withdrew from taking the appropriate measures against the organizer what did not bring the result in the form of ceasing the violation of law in the future.

According to the procedure the employer is obliged to obtain the agreement from trade unions for the termination of an employment contract with members of these organizations.
